FCA Proposes Crypto Rule Deferrals Ahead of 2027 Deadline

The FCA has introduced transitional provisions to ease the transition to full crypto regulation in October 2027. Firms must submit feedback by 12 October 2026 to secure these phased compliance measures.

The UK Financial Conduct Authority has proposed a six-month deferral for retail-facing crypto platforms. This measure aims to prevent a regulatory cliff-edge in October 2027. The proposal was detailed in consultation paper CP26/32. Market participants have until 12 October 2026 to submit feedback.

The regulator seeks to phase in compliance requirements without disrupting market integrity. These transitional provisions apply to admission and disclosure standards. They also cover execution venue rules for retail and professional clients.

Specific Compliance Deferrals Proposed

Qualifying Cryptoasset Trading Platforms receive a six-month grace period. This allows time to align token lists with disclosure mandates. UK-authorised dealers and arrangers get a three-month deferral. This covers execution venue provisions for retail clients.

Intermediaries also benefit from a three-month extension for execution policies. They must provide high-level policies from day one. This ensures client consent processes are updated in time.

Shift to Full Market Authorization

The UK moves from basic AML registration to full FSMA authorization. The FCA opens its application gateway on 30 September 2026. Firms face strict standards for operational resilience and capital. This aligns with EU MiCA and US enforcement trends.

Cross-border operators must standardize controls across jurisdictions. The shift demands higher operational overheads. Smaller firms face significant resource strain under these new rules.

Operational Risks and Deadlines

Firms missing the 28 February 2027 gateway deadline face wind-down provisions. There is no option for operational continuity after this date. Liquidity fragmentation is a risk for thinner altcoin markets. Retail access may be restricted during the transition.
