Rocket Lab Challenges NASA Mars Orbiter Award to Blue Origin

A $700 million contract for a vital Mars communication relay has sparked a formal legal dispute between two major spaceflight companies.
Rocket Lab has filed a formal protest with the U.S. Government Accountability Office, challenging NASA’s decision to award a critical Mars mission contract to Blue Origin. The California-based company argues that the agency’s selection process failed to adhere to congressional eligibility criteria and that the technical evaluation of its proposal was flawed. This dispute centers on the Mars Telecommunications Network, a single spacecraft designed to serve as a communications hub for future robotic missions on the Red Planet.
The stakes in this procurement battle extend far beyond corporate rivalry. NASA currently relies on two aging orbiters, Mars Odyssey and the Mars Reconnaissance Orbiter, to relay data from the Martian surface to Earth. Both spacecraft are well beyond their original design lifespans. The new contract, valued at $700 million, is intended to ensure that American exploration at Mars remains connected and viable for decades to come, replacing infrastructure that is rapidly becoming obsolete.
Dispute over procurement standards
Rocket Lab’s complaint, reported by GN auto tech/science: space discovery, asserts that NASA’s award decision was inconsistent with the rules mandated by Congress. The company claims that the review of its technical volume contained incorrect assertions and conclusions, effectively penalizing their bid unfairly. Rocket Lab maintains that these procurement standards exist to ensure fair competition and protect public investment, particularly for critical infrastructure that will underpin long-term scientific goals.
The agency issued a request for proposals in May, drawing significant interest from the private sector. Blue Origin and Rocket Lab were widely considered the front-runners for the job. NASA ultimately selected Blue Origin to develop, launch, and operate the network. The contract requires the company to deliver the spacecraft to NASA by the end of 2028, with the system expected to be fully operational in Mars orbit by 2030.
History of competitive protests
This legal maneuver is not new to the spaceflight industry. Blue Origin has previously found itself in a similar position. In 2021, the company filed a protest after NASA selected SpaceX to provide the first crewed moon lander for the Artemis program. The GAO denied that protest, and Blue Origin subsequently lost its lawsuit in federal court. However, the outcome was not entirely negative for Blue Origin, as NASA later decided to award a second lander contract to the company in 2023.
Vital role in Mars operations
The Mars Telecommunications Network is essential because it will act as the primary link between mission controllers on Earth and other spacecraft studying the planet. While the name suggests a broad network, the contract is for a single, highly capable spacecraft. The delay in replacing the current orbiters has left a gap in reliable communication infrastructure, making the timely delivery of this new system a priority for the agency's future scientific agenda.
