China Finalizes BCI Data Standards for Medical Devices

China's latest regulatory move establishes a unified framework for AI-driven brainwave data, targeting a market projected to reach 840 million dollars by 2028.
China has approved its third national standard for brain-computer interface (BCI) medical devices, marking a shift toward systematic regulation of the sector. The new guideline, effective September 1, 2027, is the world’s first to mandate specific requirements for AI algorithms used in processing brainwave data. This regulatory step creates a uniform baseline for how neural data is collected, labeled, and stored, removing the fragmented approach that previously hindered interoperability and clinical validation.
The standard complements two earlier frameworks released in 2025, which defined technical terminology and testing methods for implantable stimulators. According to Li Shu, a drafter of the standard from the National Institutes for Food and Drug Control, this new rule provides the necessary data quality foundation for registration reviews. By standardizing the data pipeline, the regulation reduces uncertainty for manufacturers seeking to bring AI-enhanced neurotech products to market, directly impacting their ability to secure regulatory clearance.
Regulatory Pathway Accelerates Product Launches
The National Medical Products Administration (NMPA) has integrated implantable BCIs into its priority examination catalogue for high-end medical devices. This designation guides enterprises through streamlined registration applications, while selected products gain access to innovation and "global new" green channels. Yuan Peng, Deputy Director of the Medical Device Registration Department at the NMPA, confirmed that full-process guidance is being provided to accelerate product launch. This administrative support lowers the time-to-market barrier, a critical factor for companies competing in the fast-evolving neurotechnology space.

The NMPA is currently developing a broader suite of standards, including ten national and three industry-specific guidelines.
