Scattergood Hydrogen Retrofit Faces Legal Challenge

Los Angeles environmental groups have filed a lawsuit against the city's $800 million plan to retrofit its largest gas plant with hydrogen-capable turbines, arguing the project lacks critical infrastructure details.
A coalition of environmental organizations has filed a lawsuit in Los Angeles County Superior Court to block the city’s $800 million plan to upgrade the Scattergood Generating Station. The suit, brought by groups including Communities for a Better Environment and the Sierra Club, challenges the Los Angeles Department of Water and Power (DWP) for approving the project without sufficient environmental review. The core legal argument is that the California Environmental Quality Act was not satisfied because key operational details remain undefined.
The proposed upgrade involves replacing two aging units at the beachside facility with turbines capable of burning either natural gas or hydrogen. City officials frame this investment as a necessary step toward Los Angeles’ goal of 100% clean energy by 2035. However, opponents argue that the plan effectively locks in fossil fuel infrastructure by failing to specify where the hydrogen will come from, how it will be transported, or how it will be stored at the site.
Missing Infrastructure Details Underpin the Lawsuit
The DWP’s own environmental impact report acknowledges that the source of green hydrogen for the project has not been identified. This admission fuels concerns among plaintiffs that the turbines will ultimately operate primarily on natural gas, rendering the hydrogen capability a speculative feature rather than a functional fuel source. Theo Caretto of Communities for a Better Environment stated that the city is investing nearly a billion dollars to keep a methane plant online, rather than transitioning to verified clean energy alternatives.
Experts note that the economic landscape for energy storage has shifted significantly. Solar power and battery storage have become substantially cheaper and more widely deployed, raising questions about the necessity of such a costly gas retrofit. Critics argue that without a clear pathway for hydrogen supply, the project represents a high-cost gamble that delays the adoption of more efficient and less polluting technologies.
Utility Defends Reliability Needs of Gas Plant
The DWP maintains that the Scattergood retrofit is essential for grid reliability, particularly during periods of extreme heat when electricity demand spikes. Jason Rondou, a spokesperson for the utility, cited a National Renewable Energy Laboratory study indicating that noncombustion resources alone cannot currently replace the plant’s role in the grid. The utility points to its broader portfolio, having invested $5 billion in clean energy projects, including solar and batteries, which has helped Los Angeles reach a 65% renewable energy share.
Despite these investments, the DWP acknowledges a significant risk: if hydrogen infrastructure is not built in time, the facility may continue to run exclusively on natural gas. Rondou stated that the utility is preparing equipment that is ready to utilize hydrogen if the industry develops. This strategy positions the gas plant as a transitional asset, bridging the gap between current grid needs and future clean energy capacity.
Regulatory Outcome Will Shape Energy Policy
The legal challenge at Scattergood reflects a broader national debate over the fate of aging fossil fuel plants as cleaner energy options become more cost-effective. Similar disputes are emerging in other states, such as West Virginia, where ratepayers are questioning the continued operation of aging coal plants. The outcome of this lawsuit will likely set a precedent for how utilities can justify investments in dual-fuel technologies when the alternative fuel supply chain remains undeveloped.
Courts and regulators will now evaluate whether the DWP’s environmental review was adequate and if the project represents a viable transition strategy or an unnecessary extension of fossil fuel dependence. The decision will have implications for public health, electric rates, and the pace of climate goals in one of the nation’s largest urban markets.
