Kenyan Labor Groups Press Teleperformance on Worker Safety
A formal notice has been issued to the French outsourcing giant, demanding compliance with duty-of-vigilance laws regarding conditions in Kenya.
The French multinational Teleperformance is currently under scrutiny from labor advocates who allege that its operations in Kenya are failing to uphold basic workers' rights. According to reports from Africanews, a coalition of French and Kenyan organizations has formally notified the company’s parent group of these concerns, citing significant gaps in the protection of employees within the region.
The core of the dispute centers on the legal status of staff and the severity of their daily tasks. The accusers claim that the company is not adequately safeguarding its workforce, leading to a standoff that could soon escalate from internal mediation to formal legal proceedings in France.
Allegations of Misclassified Employment Status
A primary point of contention involves the recruitment and immigration status of foreign employees. The groups assert that workers are sometimes presented to authorities as trainees rather than as bona fide employees, a practice they describe as questionable. Furthermore, the organizations allege that the company provides staff with prepared statements to use during immigration questioning, a tactic they view as a violation of transparency and fair employment standards.
These claims suggest a systemic issue in how the company manages its cross-border workforce. By potentially obscuring the true nature of the employment relationship, the accusers argue that Teleperformance is undermining the legal protections that would otherwise apply to these individuals under both local and international labor frameworks.
Exposure to Disturbing Digital Content
Beyond administrative and legal concerns, the organizations highlight the psychological toll on content moderators. The groups state that these employees are exposed to violent and disturbing material for extended periods, often exceeding eight hours per day. This level of exposure, they argue, poses significant risks to the mental health and well-being of the staff, necessitating stricter internal safeguards and monitoring protocols.
Legal Leverage Under French Law
The pressure being applied relies heavily on France’s corporate duty-of-vigilance law, which mandates that large companies monitor and mitigate social and environmental risks in their supply chains and operations. The French CGT union and two Kenyan civil society groups are demanding that Teleperformance strengthen its compliance with these statutory obligations. They argue that the current measures are insufficient to prevent the alleged harms.
The company has been granted a three-month window to engage in mediation with the accusers. If a satisfactory agreement is not reached within this period, the organizations have indicated they are prepared to take the case to a French court. This potential litigation could set a significant precedent for how multinational corporations are held accountable for labor practices in their overseas subsidiaries.
