Data Center Expansion Meets Regulatory Backlash

Governments are pausing new data center projects as power and water infrastructure struggles to keep up with surging demand.

Governments across the Atlantic are increasingly stepping in to pause or regulate the construction of large-scale data centers. This shift is not driven by ideological opposition to technology, but by the physical limits of existing infrastructure. Local communities and state officials are raising alarms about electricity and water consumption that is straining grids to their breaking point.

The result is a global trend where new permits are being frozen, audits are being mandated, and investment risks are rising sharply. For developers, the catch is clear: rapid expansion is no longer guaranteed, and the ability to secure local approval has become just as critical as securing capital.

US States Implement Permitting Freezes

In the United States, at least fourteen states are considering statewide moratoriums by 2026, according to Moody’s Ratings. New York became the first to act, signing an executive order in July that pauses environmental permits for new data centers larger than 50 megawatts. The state cited a massive backlog of load requests in its interconnection queue, which included over eight gigawatts of new demand arriving in 2025 alone.

Texas is taking a more investigative approach, ordering a comprehensive audit of every data center project currently in its grid’s interconnection process. Requests in Texas have reached 474 gigawatts, a figure that exceeds the state’s record peak demand by more than five times. Pennsylvania has also moved to require local approval for large facilities, ensuring that communities have a direct say in projects that consume significant local resources.

European Nations Reassess Energy Strategy

Europe is seeing a similar reaction, though the mechanisms differ by country. In Scotland, lawmakers are voting on a motion to pause all hyperscale data center applications until a national strategy is published. The current pipeline includes 24 outstanding applications that could draw power equivalent to 1.5 times the country's peak electricity use.

Ireland offers a different model, having lifted its grid connection halt in Dublin last December. However, it now requires operators to meet at least 80 percent of their annual energy demand from renewable sources. This regulatory tightening is necessary because data centers accounted for 23 percent of Ireland’s total electricity consumption in 2025, a significant increase from the previous year.

Financial Risks And Project Cancellations

The financial sector is beginning to reflect these operational realities. Senior bankers are now weighing community sentiment alongside traditional credit quality when evaluating data center loans. This shift has contributed to a wave of project withdrawals, including a $30 billion digital gateway project in Virginia that was abandoned due to local opposition and regulatory uncertainty.

Research firm Data Center Watch estimates that at least 75 major projects, representing over $130 billion in investment, were delayed or cancelled in the first quarter of 2026. The trade-off is evident: while the technology sector seeks rapid growth, the physical constraints of power and water are forcing a slower, more regulated pace of development.
