US Lawyer Argues Extra EV Sensors Do Not Mean More Personal Data Collection

A privacy expert challenges the assumption that Chinese electric vehicles track users more invasively than their American counterparts, pointing to significant hardware differences that may not translate to higher personal data risks.
Public debate over Chinese electric vehicles often centers on fears of excessive data harvesting, but a US privacy lawyer argues this narrative misses a crucial technical distinction. Jamilia Grier, who drives a NIO EC6, conducted a detailed comparison between her vehicle and a Tesla Model Y. She found that while the NIO contains significantly more sensing hardware, both cars collect similar categories of information regarding the driver's identity and behavior.
Grier’s analysis suggests that the volume of environmental data captured by a vehicle is not the same as the volume of personally identifiable information (PII) collected. For consumers, this distinction matters because it separates the issue of environmental awareness from the issue of personal surveillance. The core finding is that having more cameras and sensors does not automatically equate to a more invasive privacy footprint for the user.
Hardware volume differs from personal data
The physical differences between the two vehicles are stark. The Tesla Model Y relies on nine cameras and lacks LiDAR, radar, or ultrasonic sensors. In contrast, the NIO EC6 is equipped with 33 sensing units, including 11 exterior cameras, one interior camera, five radars, 12 ultrasonic sensors, and one LiDAR unit. According to Grier, this array allows the NIO to map its surroundings with greater detail, capturing more data about the road and environment.
However, when examining what is actually recorded about the driver, Grier notes that the categories remain consistent across both brands. Both vehicles collect location data, voice inputs, images from the cabin, driving behavior metrics, and recordings from when the car is parked. She described the mechanisms and storage locations for this data as being functionally identical, challenging the idea that one brand is inherently more watchful of the driver than the other.
Privacy and security are distinct legal issues
Grier emphasizes that US policy discussions frequently conflate privacy rights with national security concerns, even though they operate under different legal frameworks. Privacy law governs the conditions under which data is collected and used, while security law focuses on who ultimately controls that data and where it is stored. She points to the Commerce Department's Connected Vehicle Rule and proposed legislation as examples of policies focused on data ownership rather than the sheer volume of sensor inputs.
Regulatory requirements also play a role in data collection. Grier notes that crash data recorders are mandated in Europe and China, whereas the US has technical standards but no broad federal mandate requiring their installation. This regulatory patchwork means that some data collection is driven by compliance needs rather than corporate strategy, further complicating the narrative that all data gathering is driven by malicious intent or corporate overreach.
Consumers should review specific privacy settings
Rather than relying on broad assumptions about national origin, Grier advises drivers to read the manuals and privacy policies of their specific vehicles. She highlights several settings that users should actively manage, including cabin camera permissions, voice assistant data retention, location sharing options, and parked-car recording features. These settings determine how much personal data is actually shared and for what purposes.
The broader context of this debate is complicated by the fact that the US lacks a comprehensive federal privacy law, leaving drivers with fewer statutory protections than those in Europe under the GDPR.
