For developers, this means securing financing, purchasing land, and ordering equipment based on the promise of reliable power. If that power does not arrive on schedule, the risk of financial loss is substantial.

Legal experts warn that disputes are likely to arise over who bears the cost of necessary grid upgrades. A developer might assume that connecting to a local line is sufficient, only to find that regional transmission systems need reinforcement. This ambiguity can lead to litigation, as contracts may not clearly define responsibility for infrastructure costs that exceed initial expectations.

Practical Risks for Developers

Consider a typical scenario: a developer selects a site based on projected power availability and begins construction. However, delivering electricity to such a large load often requires new generation resources or transmission facilities that take years to build. If the power delivery is delayed by several years, the developer faces idle equipment, missed customer commitments, and ongoing operational costs without revenue.

This dynamic highlights a key trade-off in the current boom: speed versus stability. While the technology advances rapidly, the physical grid evolves slowly. Companies must now navigate a landscape where legal and contractual clarity is as important as technical capability.
